Submit a legal harassment case against Westminster.

Unfair PCN?

Unfair PCN submit a harrasement case against Westminster Council.

The NTBPT Committee has been approached by a leading solicitor/barrister in Harassment Law wanting to assist in the fight against this tax along an interesting tack, for which they need YOUR HORROR STORIES.

They suggest that one of the best ways forward to challenge it would be to collate as many “human interest stories” involving unjustified or unfairly issued parking tickets as possible. Stories and incidents that have been issued in outrageous circumstances will build up a case for a class action framing our cause of action on harassment, based upon the concepts set out in the judgement in Fergurson v British Gas, which you can download and read here.

Motorcycle and Scooter Parking Tax also discriminates against people who don’t have credit cards or mobile phones and have to try to get through to a pay centre in the pouring rain that is constantly engaged. Then when you cannot get through and have to leave your bike unattended to pay elsewhere for your parking you come back and find you have a ticket.

This poor customer care can be construed as a form of Harassment, whereby Westminster City Council or any Government Department/Corporation will have to overhaul their consultation processes, software system designs and the whole legality of their duty of care to the people they wish to tax and/or serve or represent as consumers. This will create a code of conduct that the Government and corporations need to adhere to.

We need to work out all the different circumstances in which tickets could be unfairly issued and find examples to put up as a “test example”.

If you feel you have been issued a ticket unfairly, FOR WHATEVER REASON, please fill in the following form below, after which about a dozen complainants will then be selected, who can act as potential co-claimants and who between them, have at least two examples of every kind of unfairly issued ticket we can think of i.e. got a ticket when visiting a library to purchase a ticket, when topping up the mobile phone in order to buy a ticket etc. We need two examples of each in case we fail to prove one of them. This means that we will need to cite about twenty four examples of improper tickets giving the reasons why. Collectively we can beat this unfair and illegal tax and make sure our Government representatives are answerable to the electorate and serve the best interests of local businesses or they will be voted out.
